AlterProd – Terms of Service.

General

These general terms and conditions of sale are concluded on the one hand by AlterProd SRL, established in Belgium, Rue de l’Incroyable 43, 7340 Pastures, registered with the “Banque Carrefour Enterprises” (BCE), under number BE0797.855.286, hereinafter referred to as “the seller” and on the other hand, the customer defined below as a user of the www.alterprod.be site and accepting these general terms and conditions of sale, hereinafter referred to as “the Buyer”. The purpose of these terms and conditions of sale is to define the contractual relationship between the seller and the buyer and the conditions applicable to any purchase made on the “AlterProd” merchant site (internet address: https://alterprod.be/), whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies an unreserved acceptance by the buyer of these terms and conditions of sale. These terms and conditions of sale shall prevail over any other general or special terms and conditions not expressly agreed to by the seller. The seller reserves the right to change its terms and conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

The products and services offered are those that appear on the pages published on the seller’s website or indicated via a written offer sent by the seller to the buyer. These products and services are subject to availability. If a product mentioned as available should be out of stock, the seller offers the buyer the possibility of 1) cancelling the order, 2) modifying his order by choosing, on the site, another item of the same value. This is without any compensation to the buyer. Each product, which is sold via the site, is accompanied by a summary description, on the site, drawn up by the seller. The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the offered product, especially regarding colours.

Price

The prices shown on the website are expressed in Euros and include the legal value added tax according to the rates and laws in force in Belgium, but do not include delivery costs. Any change in the rate may be reflected in the price of the products or services. The seller reserves the right to change its prices at any time and without prior notice, it being understood, however, that the price appearing on the site on the day of the order will be the only one applicable to the buyer. In the event of an incorrect price being displayed (due to a technical error, a manual error or a computer bug) the order will be cancelled, even in the case of initial validation.

Orders

If the buyer wishes to place an order directly on the site, an account will be automatically created when their first order is confirmed. For this purpose, they fill in, according to the information provided to them online, a form made available to them in which they will include the information necessary for their order and their future identification, including their surname, first name, telephone number, postal address, email address, billing, and delivery address. If the buyer has already made a purchase on the site; They will first need to log in to their account. The buyer can specify a different delivery address in the comment field than the one specified for invoicing. The buyer, after having chosen the products presented, will definitively validate his order by clicking on the “ORDER” button to express his commitment and acceptance of the general terms and conditions of sale. From then on, the order is registered, and an order number is communicated to the buyer as well as a confirmation on the screen and by e-mail. The data recorded by the https://alterprod.be/ website constitutes proof of the nature, content, and date of the order. The invoice shall include details of the price of each product, excluding tax and, where applicable, the amount of VAT calculated on the total excluding tax and included in the total including VAT. The delivered goods remain the exclusive property of the seller until all debts have been settled. If the buyer does not pay on time, the seller has the right to claim the goods supplied by way of return, without prior notice.

Terms of payment

The price is payable at the time of ordering. The buyer can pay by credit card or instant payment. In the case of payment by credit card, the buyer transmits his card details as part of the order process. After proper legitimation, the seller will ask the credit card company to initiate the payment transaction. The payment transaction is automatically executed by the credit card company and the credit card will be charged. Payments by credit or debit card will be made through the payment provider “Stripe” which uses a secure protocol so that the information transmitted is encrypted by software and no third party can see it during transport on the network. The seller does not accept payment by bank transfer or cheque.

Delivery & Transportation

Delivery is only made after receipt of payment. For all payment methods, the delivery time starts one day after the order has been placed and paid. If the period begins or ends on a Saturday, Sunday or public holiday, then this period is extended to the next working day. The seller has the right to make partial deliveries, within reason, taking into account that any interests of the buyer are not affected. This has no influence on the content of the contract, the performance due by the seller or the agreed execution period. In the case of partial delivery, no additional costs will be incurred by the buyer. Failure to comply with the deadlines does not entitle the buyer to damages or to the rejection of the ordered goods. The shipping costs are specified in the summary of the order that precedes its validation.

Deliveries are made to the address indicated in the purchase order or in the field provided, if the buyer has desired the delivery address to be different from the billing address. The risks are borne by the buyer from the moment the products have left the seller’s premises. Orders are sent from Belgium. The seller undertakes to make every effort to deliver the goods as soon as possible and to take the necessary steps in the event of an abnormally long delay. The seller cannot be held responsible for any error or impossibility of delivery caused by the buyer miscommunicating the delivery address on the order.

In case of return of the package to the seller, the buyer can maintain or cancel the order. In the event of a reshipment of the package, the new delivery costs may be charged to the buyer, it being understood that the delivery costs already incurred are non-refundable. In the event of force majeure or exceptional events (natural disasters, epidemics, strikes, lockouts, war, etc.) delaying or prohibiting the delivery of the goods, the seller is released from any liability. In any case, delivery within the stipulated period can only take place if the buyer is up to date with his obligations towards the seller. In the event of a stock shortage, either the item will be removed from the site or the item will be reported as out of stock on the site with a potential replenishment time if a future reproduction is planned. If the seller does not know what a restocking period is, the seller will indicate it on the item’s link on the website.

Retractation

In accordance with the Belgian law of 6 April 2010 (law on market practices and consumer protection), buyers, non-professional natural persons, have a withdrawal period of 14 days from the day after delivery of the product to return the product to the seller for refund without penalty. The buyer will be reimbursed no later than 30 days after exercising the right of withdrawal. Used, installed, damaged or incomplete products will not be returned. If the item is already being delivered or has already been delivered, the delivery costs will not be refunded. The cost of returning the item is also not refunded. The buyer who wishes to exercise this right must contact the seller via the contact form on the website or by email: or by post to AlterProd SRL, Rue de l’Incroyable 43, 7340 Pastures, Belgium. Within a maximum of 30 days after acceptance of the return, the seller will refund the amount paid.

Warranty

All products supplied by the seller are covered by the Belgian legal warranty. In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made by post to AlterProd SRL, Rue de l’Incroyable 43, 7340 Pastures, Belgium, within 30 days of delivery. We are obliged to inform you that the European Commission provides a corresponding platform for the so-called online dispute resolution. Claim

If the packaging is damaged upon delivery, a description of the damage must be noted and signed on the delivery note that will be given to the delivery person if the package was delivered by a carrier and to the postman if the package was delivered by a postal service. It is the buyer’s responsibility to check immediately upon receipt of the goods for their condition and compliance with the contract. In case of delivery by courier, by signing the delivery note, the buyer accepts the products delivered in the same condition and therefore no claim for damage during transport will be accepted. All complaints relating to defects in the delivered products, inaccuracies in quantities or incorrect reference to the order confirmed by the seller must be made in writing within 2 days of receipt of the products, otherwise the right to complain ceases to exist. The seller can refund the missing item or reship it.

Responsability

The seller is only responsible for the own content of his online shop on the website. The seller, in the online sales process, cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other unintentional problems. The seller cannot be held responsible for any misuse of products purchased on the site. Property damage and/or personal injury resulting from misuse of the product or misuse of the source on which the product was installed is the responsibility of the purchaser.

Intellectual property

All elements of the Seller’s Site are and remain the exclusive intellectual property of the Seller. No one is authorized to reproduce, exploit, redistribute or use for any purpose whatsoever, even partially, elements of the site, whether they are software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of the seller. The seller reserves the right to take legal action if a violation is found.

The seller undertakes not to disclose to third parties the information that the buyers communicate to him. Buyers’ contact details are only passed on to the partners who are necessary for the processing of the order. In accordance with European Regulation 2016/679 of 27 April 2016 on the protection of privacy with regard to the processing of personal data, the buyer has at any time the right to access and rectify such data as well as the right to object if you no longer wish to be informed of our activities. Archiving – Evidence

The seller shall archive the purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the legal provisions. The seller’s computerized records will be considered by the parties as evidence of communications, orders, payments and transactions between the parties.

Consumer rights

These terms and conditions have been drafted in accordance with Belgian law. If any clause in these terms does not comply with Belgian consumer protection legislation, that legislation shall prevail.

Dispute Resolution

In the event of a dispute, an amicable solution will be sought before any legal recourse. These online terms and conditions of sale are subject to Belgian law. In the event of a dispute, only the courts of the judicial district of the registered office of the online store of the “AlterProd” website will have jurisdiction.
